A lot of people are unsure of their rights when they have an insurance claim. The insurance companies are supposed to send you a letter explaining your rights, but somehow it does not make it to everyone.
However, I found this link, courtesy of Sedgwick, Detert, Moran and Arnold, LLP. This provides you with the California Fair Claims Practices Act in a readable format. Its a great resource and the firm, which defends insurance companies, did a great service putting it out there.
Now you can answer questions like, “How long does the insurance company have to respond to my letter?” “Can the insurance company discriminate against me?” “Can the insurance company require me to take a lie detector test?”
Use this resource, but understand that it is not a substitute for competent legal advice.
