There are a lot of politicians out there now running around talking about caps on pain and suffering. They usually attack medical malpractice awards and try to limit damages to $250,000 as is done in California.
But, before you listen to them, look closely. Thanks to my friends at the Wisconsin Personal Injury Lawyers Blog, I came across this article on Sen. Rick Santorum. The Senator’s wife was injured by a chiropractor and they sued for $500,000. They recovered $350,000. Sen. Santorum, who testified, told ABC that he supported his wife, but does not always agree with what she does.
Caps on damages are a bad thing. They do not lower insurance premiums. They do not protect defendants. All they do are line the pockets of insurance companies.
The next time you hear someone talking about caps on pain and suffering, remember Sen. Santorum.
