This issues gets brought up all the time. I have had people call me and say “Your client is at fault for this accident.” I ask, “Why?” They say, “He was uninsured. You cannot drive without insurance. So, he should not have been on the road and the accident would have never happened.”
This is an easy one. They are wrong. Let me give you some examples: Your car is parked, uninsured, and hit. It is not your fault. Or, you are stopped at a red light and rear ended. It is not your fault.
Insurance, or the lack thereof, is not a factor in determining fault for an accident. Do not listen to people who tell you that you are at fault because you are uninsured. Insurance information is not even admissible in court.
You should be insured, but if you are not, it does not make you responsible for everything that happens on the road.
