You hear a lot today about “tort reform.” What is it? Basically, it is an attempt by big business and insurance companies to limit your right to sue in court. Why does it matter?
First, it matters because you have a right to have your damages paid for by someone. What if a business manufactures a product that injures people and you cannot sue? What incentive do they have to take the product off the market? None.
Second, tort reformers are just not honest. Big business files many more lawsuits than individuals. Big business employs more attorneys than individuals. And big business uses creative names to hide what they do.
Civil Justice Association of California? Big business tort reform group. Triallawyersinc.com? Another tort reform group. They come up with creative names to hide who they are and what their mission is. Triallawyersinc.com actually calls itself a grass roots campaign.
The next time someone talks to you about tort reform, or your read about it online, ask yourself who is behind the “facts” they present.
