An attorney in Louisiana sued his client for his fee after his client rejected a settlement offer and the case resolved for no money. The Louisiana Supreme Court rejected his argument and he was awarded nothing.
The Court said: “With the benefit of hindsight, it would have been in Mr. Cole’s best interest to accept the settlement offer obtained by Mr. Culpepper,” the opinion said. “However, it is clear that the decision to accept a settlement belongs to the client alone.”
Remember that when you hire an attorney, you have the final decision on accepting an offer. Your attorney cannot accept an offer without your consent.
