Q: I was sued on a debt that is more than 4 years old. How do I prove the statute of limitations?
A: Court is a complex creature. You cannot walk into court and expect the judge to dismiss a case because you claim the statute of limitations has expired. You need to PROVE it. How? You can either set a motion (a motion for judgment on the pleadings or a motion for summary judgment) or you can prove it at trial through admissible evidence. But, the judge will not dismiss it just because you have evidence unless you follow the proper procedures.
