People call me often and ask about filing for bankruptcy. My basic answer is the same: I don’t know. I am not a bankruptcy attorney. I don’t handle bankruptcy cases nor will I. I will refer these people to an attorney who can help them file for bankruptcy.
But, some people may not need to file for bankruptcy. The Alabama Consumer Law Blog has a nice piece about suing debt collectors instead of filing for bankruptcy. The post talks about going on the offensive against debt collectors when they cannot prove you owe the debt. This can also work to clear up your credit report and improve your credit score. By going on the offensive, you may be able to avoid filing for bankruptcy.
