I have warned you time and again about being careful of working with non-attorneys for a loan modification. Well, now a new warning: if you talk to anyone besides an attorney and they claim they are working with an attorney, call that attorney.
I have a new case where my client retained one of these modification companies. The company claimed it was working with an attorney. It even had her sign a fee agreement with the attorney. Then she got suspicious when nothing was being done. She was told she would get a refund and none came. She called me.
After reviewing the documents closely, I did some research on the attorney. It seemed odd that he would be doing modifications. So, I called him. We had a nice talk. He had no idea who this company was or why they were using his name. He did some checking and this company had found this fee agreement and claimed it came from another company. So, they were using it WITH NO AFFILIATION with this attorney. That’s right – they were lying to people.
If you hire anyone other than attorney, check out the company carefully. Heck, even if you hire an attorney go to Avvo and check them out. Another client hired an attorney who had a history of discipline. Make sure you check out anyone you think about hiring.
